These Terms & Conditions (“Terms”) govern the services provided by Shri Swadishtam (“we”, “our”, or “us”). By placing an order with us through any platform, including third-party food delivery applications, you agree to be bound by these Terms.

1. Nature of Business

Shri Swadishtam operates as a Cloud Kitchen, engaged in the preparation of food items. Orders are accepted and delivered primarily through third-party food delivery platforms, including but not limited to Zomato and Swiggy.

2. Ordering & Acceptance

  • All orders are subject to availability and confirmation by the respective delivery platform.

  • We reserve the right to accept or reject any order at our discretion.

  • Once an order is confirmed, it cannot be modified or cancelled except as permitted under the policies of the respective delivery platform.

3. Pricing & Payments

  • Prices, taxes, delivery charges, and other fees are displayed on the food delivery platform at the time of placing the order.

  • Payments are processed securely through Zomato, Swiggy, or their authorized payment partners.

  • Shri Swadishtam does not collect, store, or process any payment card, UPI, or banking information.

4. Preparation & Delivery

  • Food preparation times provided are estimates and may vary based on order volume and operational factors.

  • Delivery services are managed by third-party delivery partners assigned by the platform.

  • Shri Swadishtam shall not be responsible for delivery delays caused by traffic, weather conditions, technical issues, or delivery partner availability.

5. Food Quality, Ingredients & Allergens

  • We strive to maintain high standards of food quality, hygiene, and safety.

  • Menu images are for illustrative purposes only; actual presentation may vary.

  • Customers are responsible for reviewing ingredients and identifying potential allergens.

  • Shri Swadishtam shall not be liable for allergic reactions or health issues arising from food consumption, except where required under applicable law.

6. Cancellations, Refunds & Complaints

  • Cancellations, refunds, and replacements are governed by the policies of Zomato or Swiggy.

  • All complaints or issues related to orders must be raised through the platform from which the order was placed.

  • We will cooperate with the platform in resolving genuine concerns where applicable.

7. User Conduct

By using our services, you agree not to:

  • Provide false, misleading, or inaccurate information

  • Misuse the platform or services for unlawful purposes

  • Harass, abuse, or threaten our staff or delivery partners

We reserve the right to refuse service in cases of misuse or misconduct.

8. Intellectual Property

All brand names, logos, images, menu content, and other materials associated with Shri Swadishtam are our intellectual property and may not be copied, reproduced, or used without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Shri Swadishtam shall not be liable for any indirect, incidental, or consequential damages.

  • Our total liability, if any, shall be limited to the value of the order placed.

10. Third-Party Food Delivery Platforms

When you place an order through Zomato or Swiggy:

  • Their respective Terms & Conditions and policies apply in addition to these Terms.

  • Shri Swadishtam is not responsible for platform-related technical issues, payment processing, data handling, or service policies.

11. Force Majeure

Shri Swadishtam shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, government actions, strikes, technical failures, or supply chain disruptions.

12. Changes to Terms

We may update these Terms & Conditions from time to time. Updated terms will be effective upon posting with a revised “Last Updated” date.

13. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.
Courts located in Meerut, Uttar Pradesh, shall have exclusive jurisdiction.
